Man Guilty of Fatally Beating 9-Week-Old Daughter
WEST BEND, Wis. (AP) -- A West Bend man has been found guilty of fatally battering his 9-week-old daughter.
A jury in Washington County deliberated about seven hours Thursday before finding Michael Below guilty of first-degree reckless homicide and child abuse.
Prosecutors say the 31-year-old West Bend father lifted his child by her feet last August and banged her head on a wooden changing table several times. The criminal complaint says hospital tests showed the child suffered severe brain injuries, hemorrhaging in her eyes, a skull fracture and brain swelling.
The defense unsuccessfully argued that the decision to stop nourishment to the baby at Children's Hospital of Wisconsin was the cause of her death.
A pre-sentence investigation was ordered.

Below could be sentenced to prison for up to 60 years on the homicide conviction. Since Below has a previous felony criminal record, a judge could add up to six more years on the sentence.
Below also was convicted of physical abuse of a child, creating a high probability of great bodily harm, for fractured ribs and other injuries suffered by the girl between late July and early August. He could be sentenced to up to 12 years and six months in prison on this felony, with up to six more years added for being a repeat felon.
Gonring did not immediately set a court date for sentencing.

i think that ancient people had it right, make the punishment fit the crime, if you kill someone you die, simple as that. take it one step further and make them die the same way as their victim JMO
