Restitution Hearing 12/19

I assume Stewart was in court for the sentencing of the other defendants because it was originally announced that the restitution hearing would immediately follow. that hearing is postponed to the 19th. my question is, why wasn't orenthal there? why wouldn't he be part of the restitution?

I think the 'personal stuff'; i.e., family pictures will be easy enough to separate but I don't know about the rest of it. evidently orenthal thought it was all his so maybe the court will turn over everything to the civil judgment.

I don't understand why Simpson allowed anyone to remove the personal pictures from his house. I don't think the Goldmans would have ever had a claim on them. I guess he wasn't taking any chances.

That sounds fair to me. I don't think Simpson's family should lose their family pictures because he was so greedy that he gave them away.

I hadn't thought of that but that could be the case. I bet that was quite a scene when all that stuff was being hauled away...I'm sure the fur was flying. Is that the same sister that swooned in the court room? Maybe her home should have been searched for some of loot she carted away...these people never cease to amaze me.

I had an earlier correspondence with someone and thanks to that very smart lady, some great points were made about the ownership of orenthal's family treasures:

the "personal family photos" and other "personal family items" orenthal brought up in court and on the tapes were about things allegedly legally sold at auction after rental fees on storage bins in his mother's name were not paid. Supposedly some singer's manager bought the stuff at auction and wanted Fromong &/or Beardsley to sell it for him. Contents of unpaid storage units go up for auction all the time. It's possible the guy didn't even know what he had until after it was bought. If the stuff was so important to orenthal and/or his family, it shouldn't have been shunted away in a storge locker somewhere or at the very least members of the family should have known where it was and made sure it was made part of Eunice Simpson's estate and divvied up amongst the family.

this should make it even more interesting:

VICTIM NEED NOT PRESENT “PROOF” OF LOSS AT RESTITUTION HEARING
So says the California Court of Appeals in the recent case of People v. Gemelli. In that case, the victim provided information regarding losses sustained as a result of a burglary, but did not submit “proof” of loss in the form of receipts and the like. The Court found that, once a crime victim sets forth a prima facie showing of economic loss, the burden shifts to the defendant to disprove the loss claimed by the victim. The Court ruled that there is no requirement that the victim provide independent or verified “proof” of loss in order to meet this prima facie standard.

If it's truly the case that the stuff was auctioned for that reason then I don't see where Simpson has a claim to any of it.

A hearing is scheduled involving the memorabilia at the center of the OJ Simpson robbery case.

Next Friday, the court will have to determine who is the legal owner of the items.

Most of OJ's co-defendants are expected to be at Friday's restitution hearing.

Simpson was sentenced to at least 9 years in prison for his role in the Palace Station robbery.

It should be very interesting to see what happens. The Goldman's , on the day of OJ's arrest in this case, filed to get the memorabilia that was seized as evidence for the criminal case.

I know the judge in this case attempted to berate Mr. Simpson for referring to them as the Gold Diggers. However, they earned the title by their behavior and Mr. Simpson, in my opinion, was simply giving their despicable greed it's rightful name.

this may just be the first time in 14 years that Ron is resting in peace. His murderer, orenthal james simpson, is behind bars. you obviously feel differently about what price you place on your loved ones -- but then each to his own.
