The attorney for Dr. Phil Astin III said he will file a motion today to have his client released from house arrest.
Attorney Manny Arora declined to go into specifics when reached late Thursday afternoon, but said he expected to have the paperwork filed in U.S. District Court.
Astin, a Carrollton physician who was forced to surrender his medical license in June, has been under house arrest since being indicted on seven federal counts in the wake of the deaths of professional wrestler Chris Benoit and his wife and son this summer. The indictments dealt with prescriptions to two unnamed patients, neither of whom was Benoit.
Arora filed additional motions Thursday to have evidence suppressed from a third federal search of Astin's office on July 9, court records show, saying the search warrant was obtained without probable cause. Arora had filed two similar motions last month in connection with other searches of Astin's house and storage units.
No rulings have been made on any of the motions.
