WWE News: ABC News details more about disputed estate of Chris and Nancy Benoit

By Wade Keller, Torch editor
Aug 16, 2007, 13:22

ABCNews.com published a story today on the legal dispute over the estate of Chris Benoit.

Nancy Benoit's family is disputing that she necessarily died first because, if she did, all of her assets would have gone to Daniel, still alive, and then when he died, Daniel's acquired assets would go to his half-siblings rather than Nancy's family.

Nancy's attorney says regarding Nancy being killed before Daniel that "we've come to learn that there are some facts that might indicate that that's not exactly the way it happened."

WK ANALYSIS: In some states, there is a 48 hour rule that assets do not move from one person to another for 48 hours to avoid truly unfair circumstances such as this where order of death can derail the logical, fair distribution of someone's assets. The fact is, disputing the estates, which rightfully should be split between the two living families, is going to lead to lawyers getting a cut and the distribution of large sums of money delayed for years. This should not be a case of one side or the other getting "greedy" because they think the law technically is in their favor. In my opinion, there is no way either Nancy or Chris would have wanted all of their assets going to one side or the other, and their survivors should honor what they know to be true - and that could be accomplished without lawyers playing to their greed to fight for it all so they can get their cut. Obviously, Nancy would have wanted her family to get some of her acquired assets - and she had rights to Benoit's assets as his wife. Chris would have wanted his first children to be taken care of and not have all of his assets go to his wife's family after she died and not to his first kids.
