What do you all think about the Duke University Lacrosse team rape charges being dropped today? I think that this is a long time coming. This woman has changed her story so many times. There are so many inconsistencies with her story. Even today she changed her story. She said that a penis did NOT penetrate her. Well, why are you telling us this 4 months after you accused them of raping you? Why should we believe anything she is telling us now? She is a proven liar. There are more holes in her story than Swiss cheese!

Mike Nifong is being stupid IMO for not dropping all of the charges. He has done a terrible job on this case, so I can’t say that I expected anything but a stupid decision from this incompetent politically motivated sorry excuse for a District Attorney. This accuser & District Attorney Mike Nifong have done a disservice to REAL rape victims everywhere. The way he handled the case is a disgrace & I think he needs to be impeached. Sadly the voters in Durham North Carolina didn’t get to see Ninfong’s real colors until after the election.

As I'm in the UK I don't really know much about it. Was the accuser talking to the press? If she was I am amazed, in Britain, if a alleged victim of a serious crime talked to the press before the trial, the case would be likely thrown out. If not and this is her police statement why was it released?

No she wasn't talking to the press. Nor have any of her statements been released to the media. What happened was that the District Attorney of Durham North Carolina, Mike Nifong interviewed the AV & the AV said that she was NOT penetrated by a penis, so he dropped the rape charges, but kidnapping & sexual assault charges remain.

This case has been VERY controversial. Some say Mike Knifong was driven by politics, because the AV was black & they said he used this case to get elected by the black community in Durham North Carolina. His critics have said there wasn't enough evidence all along.

Last week in there was a hearing. Where it was revealed that the AV was pregnant. The results of the DNA tests were in & there was DNA in her of 7 men, NONE of them matched the 3 men accused of rape.

And this is a change from her initial story where she claimed she was penetrated orally, anally, and vaginally and they ejaculated without condoms.

Wasn't her initial, initial story that it was 20 men or am I remembering something else?

I agree. I think Nifong is a TERRIBLE prosecutor. He didn't even interview the bag of lies until 4 months after she said they raped her! There is NO excuse for that BS.

That's possible, as he didn't drop the rape charges because of no DNA match. He had planned on persuing the charges in spite of no DNA match, on the basis of the accuser's word alone, without corroboration. I wonder if the defense can keep the DNA evidence in trial, if the prosecution argues to keep it out? She did @ 1st say she was raped, then changed the story.

Charges Could Force Nifong Off of Duke Case

RALEIGH, N.C. (Dec. 29) - Ethics charges filed against the prosecutor at the center of the Duke lacrosse sexual assault case might constitute a conflict of interest that forces him off the case, legal experts said.

"It's hard for me to imagine how he can be effective as an advocate, with either the court or a future jury, when he has ethics charges pending against him ... concerning his conduct of this very same case," said Joseph Kennedy, a University of North Carolina law professor.

The North Carolina bar filed the ethics charges Thursday, accusing District Attorney Mike Nifong of violating four rules of professional conduct by making misleading and inflammatory comments about the athletes under suspicion.

Kennedy said Nifong should recuse himself, but added that the judge overseeing the case could also order his removal. The ethics charges carry penalties that range from admonishment to disbarment.

Most likely. The defense can argue its relevance on the basis that it's important to the overall scheme of the case as evidenced by the prosecution's pursuit of that evidence via testing.

I think eventually all the charges, against Evans, Seligman and Finnerty will rightfully be dropped. Hopefully, Nifong will suffer the consequences of his political ambitions at the expense of three families, whose lives have been negatively altered due to his, IMO, criminal misconduct.

Presumably, Nifong is a smart guy. He had to know he was taking a big gamble with his actions. I guess he didn't care. I'm starting to think DAs should be appointed and not elected. There's just too much nonsense whenever politics are involved in anything.

I have been following this case from almost the beginning and I feel the two special prosecutors assigned will go ahead to trial.

They have made no move to dismiss.

I'm well aquainted with the tactics used by defense attorneys to get their clients off but this case takes the cake. They always make sexual assault victims into lying drug addicted bi-polar money grubbing females. I'm sick to death of them and I will never trust any defense attorney when it comes to a rape victim. imo
