Death Penalty or Life in Prison?

When you go to the Reno Gazette-Journal website that is devoted to the Darren Mack case and has all the articles that have appeared in that newspaper, the legal affairs reporter, Martha Bellisle, asks readers if this should be a capital case. She reports that some of the experts she's spoken with say none of the aggravators are there to fit the crime.

After reading all the articles on this case from day one, and reading the search warrants and affidavits, I feel it's clear that Darren Mack planned the murders well in advance of the crimes. The rental of the Ford Explorer a week in advance of the events of June 12th is one detail that shows advance planning.

I throught that premeditated murder - first degree murder - is a capital offense. I think in most states, first degree murder is considered a capital crime. Does anyone know what the criteria is in Nevada for a capital crime? Below is the question stated by the RGJ legal affairs reporter, Martha Bellisle:

With the question of the prosecutors and Washoe District judges decided, and a new judge appointed, the next question is whether Darren Mack should face the death penalty. The chief prosecutor said a committee will review the case and decide, hopefully before next Wednesday's arraignment. Some legal experts I have talked with say this isn't a death penalty case -- none of the aggrovators fit the crime. Should it be a capital case?
