It will be a tough call to determine whether the problem with the defense tactic was because Yale was an idiot or his client truly believed he was above the law and, like a couple of posters on this board, refused to admit what he was legally wrong.

orenthal really is a stupid man. This from his own Writ:
“Simpson fully disclosed his plan to Yale Galanter, and Galanter advised him that he was within his legal rights and could lawfully go forward with the plan, so long as he did not make any uninvited entry into property of another and did not use physical force to take the property if the sellers would not return the property upon demand,” reads Simpson’s habeas corpus petition. “However, Simpson also contends that Galanter did not advise Simpson that carrying out the plan could subject him to criminal charges, regardless of his ownership of the property.”

Sounds like oj should be suing his lawyer for bad advice (or incomplete, whatever) but that really has nothing to do with the fact that he was tried and convicted. His defense @ the trial was not incompetent. His advice before committing his crime was. Conviction should stand. IMO, of course.

Anybody know if this hot mess is streaming live anywhere? HLN is pushing me over the edge with what they think is important, i.e., only OJ's testimony.

LOL Oh woo hoo for OJ -
Simpson granted 1 hand free during Vegas hearing
LAS VEGAS (AP) — O.J. Simpson won a small victory on Tuesday when he returned to court for Day 2 of his attempt to win a new trial in his robbery case: A judge said he could have one hand unshackled to drink water and take notes.

In the hours before the confrontation, Simpson said, he had been drinking. He testified that his former lawyers never told him that that fact could have been used in his defense.
He also said he was really tired that day because he normally takes a nap in the middle of the afternoon, but didn’t get the chance.
"That really was bothering me,” he said.

I've heard of the "I was drinking or on drugs" carp before, but this is the first time I have heard about "I didn't get my usual nap" defense!!! Altho, everyone in this world (especially someone so worldly as oj, and @ his age) KNOWs drinking clouds your brain, you do dumb or illegal stuff. BUT, it is no defense (IMO) because you drank anyway.

Thought it was interesting when he said he told Riccio that he wasn't going to chase after the stuff -- that Riccio needs to get it and call him. Besides, I thought this was about Galanter -- WTH?
