NORTH TONAWANDA, N.Y. (WIVB) - A Niagara County man will serve two and a half years behind bars, for violently shaking his own baby.

A judge sentenced 19-year-old James Tobey Thursday afternoon.

Prosecutors say Tobey shook his six-week-old daughter because she wouldn't stop crying.

The baby survived, but was said to have suffered a brain injury.

Investigators say the baby had been crying because of broken ribs she suffered when her father squeeze her on a previous occasion.

I get the feeling that on the whole people who abuse their own children get lighter sentences than if they inflicted the same injuries on an adult stranger.
