Drew Peterson Arrested in 3rd Wife's Murder

Police took Drew Peterson into custody around 5:30 p.m. today in connection with the death of his third wife, Kathleen Savio.

Savio's brother told NBC Chicago that state police notified him of Peterson's arrest.

"Right now we are ecstatic, we are just so happy. He's being arrested for the murder of my sister, Kathleen." Henry Savio said.

Will County State's Attorney James Glasgow is holding an 8:30 p.m. news conference with state police to announce details of the murder indictment.

Six police cars were at Peterson's home Thursday evening. Peterson's children were led out of the home around 6:15 p.m.

Savio's body was found in a dry bathtub in their home in 2004. Her death was initially ruled an accident, but later classified as a homicide after a second autopsy was done.

Peterson's fourth wife, Stacy Peterson, disappeared in October 2007. He has been named a suspect in her disappearance.

Pam Bosco, a friend of Stacy Peterson's family, said she'd anticipated this arrest for some time, and "we're still a-flutter."

"We've always said we were in full support with the Savio family and their search to find out what happened to Kathleen, and we believe that once we have that information it'll also help us with Stacy's situation, because Kathleen and Stacy had one common factor, and that was Drew Peterson," Bosco said.

Drew, 55, has been all over the news since his wife disappeared. In recent months he's gone on morning radio talk shows about his on-again, off-again girlfriend, 23-year-old Christina Raines. This week, he was offered a job by the owner of a brothel, the Moonlite Bunny Ranch, to be part of its HBO show, Cathouse

Kathleens murder will be avenged, but I fear Stacey's body and murder will never be found, nor addressed. No closure.

Kathleen's children will now have to go through the trial and know more than they need to know, but they also know a side of Drew Peterson and maybe knew things about him but feared saying anything. I'd like to know if any of them will be testifying for the Pros?

Guess this means he won't be working at the Bunny Ranch......awwwwwwwww. Cheer up Drew, you can still make 5 cents an hour in the laundry room...but only if you're a Good Boy!

JOLIET, Ill. – Drew Peterson's third wife will have a chance to "testify from the grave" under an Illinois law passed amid the media frenzy over his missing fourth wife, but some say prosecutors could be on shaky legal ground if they plan to build their murder case around that testimony. Peterson appeared in court Friday, the day after he was charged with killing Kathleen Savio, his third wife who was found dead in a dry bathtub in 2004 with a gash on the back of her head.

Wearing a red jumpsuit, the 55-year-old Peterson showed off his handcuffed hands and told reporters: "Three squares a day and this spiffy outfit. Look at all this bling." A judge postponed his arraignment until May 18 because no Peterson attorneys were present at the hearing.

Prosecutors have not said much about the evidence they have against Peterson in Savio's death, but it's clear they want to use the law to let Savio tell jurors why Peterson wanted her dead.

"In essence, what you're basically allowing the victim of a violent crime to do is testify from the grave," Will County State's Attorney James Glasgow said Thursday in announcing the charges against Peterson.

The Illinois law allows a judge to admit hearsay evidence in first-degree murder cases if prosecutors can prove the defendant killed a witness to prevent them from testifying. It passed last year amid attention to the October 2007 disappearance of Peterson's fourth wife, 23-year-old Stacy Peterson.

Possible evidence in the Savio case includes letters of protection in which she said Peterson would kill her to shut her up and her sister's testimony to a coroner's jury that Savio told her family it would be no accident if she died.

Peterson's attorneys have vowed to challenge the constitutionality of admitting such evidence. The Constitution guarantees criminal defendants the right to confront his accusers, something they can't do with an absent witness.

Joel Brodsky, one of Peterson's attorneys, has said that allowing Savio's statements would amount to the court allowing "rumor and innuendo" as testimony.

Brodsky also said he could argue that the law was passed specifically to put Peterson behind bars, which is also unconstitutional.

"They're changing the law, changing the rules, changing forensic findings to get this guy," he said. "The law was not supposed to be made for a particular case."

The law's sponsors were careful never to link it publicly to Peterson. State Sen. A.J. Wilhelmi, D-Joliet, said the law wasn't designed for any single case, but one Republican analysis of the Democratic bill noted that it was introduced "in response to the Drew Peterson case."

The law requires a judge to hold a pretrial hearing to study whether the evidence shows that the defendant killed a witness and did so to prevent the witness from testifying. The judge would also have to decide whether the hearsay is reliable and whether admitting it would be in the best interests of justice.

The process alone puts the law on shaky ground, according to Joseph Tacopina, a defense attorney whose clients included a suspect in the 2005 disappearance of American teenager Natalee Holloway in Aruba.

Tacopina said the judge's decision to admit statements would indicate to a jury that the judge thinks the suspect is guilty.

David Erickson, a former appellate court judge who teaches at Chicago-Kent College of Law, believed the law will stand up and said at least 12 other states have passed similar statutes.

He also said the Illinois bill and those of other states came in response to a 2004 U.S. Supreme Court decision that found the right of a defendant to confront his accusers has a key exception: if the defendant acted with the intent to prevent that person from testifying.

"Think of mob cases where they kill guys to keep them from testifying," he said.

State Rep. Jim Durkin, R-Western Springs, said the concept isn't controversial, but the Peterson case helped the legislation pass quickly with hardly any opposition.

"It became noteworthy because the Drew Peterson situation was starting to pick up some steam," said Durkin, one of the measure's sponsors in the state House.

Savio's cause of death, initially ruled an accidental drowning and later reclassified as a homicide, also will figure prominently in the trial.

"It definitely provides a lot of fodder for a criminal defense lawyer when you have a changed opinion," Brodsky said. "Why not change it again, and again?"

I listened to a couple of Drew's past interviews on LKL's repeat show this am. Drew will never ever confess to doing any harm to any woman. He blames their troubles on their childhood. The author of the book about him stated he believed Drew is guilty. Sorry I have forgotten his name. It is a recently published book on Drew. This author interviewed Drew many times.

Nightline did a little bit story on him the night he was arrested. They showed a snippet of an interview they did with him a few months ago where he and the reporter drove to the house she died in. Though I can't quote word for word, when the reporter asked if it was hard for him to be there, he replied something like 'yeah, it's hard, but life goes on. Just gotta get over it and move on." It was said so nonchalantly (sp?), cold, sent a shiver or 10 up my spine.

Someone posted earlier that it's about time; he's been walking around enjoying life. I'm hoping that LE and the DA spent that time carefully getting all their evidence together to make sure he does go down. I mean, it's not like that arrogant POS is going to go anywhere. There are too many eyes on him to be able to sneak off and disappear into oblivion.

My own personal opinion has always been that Stacy has been run through a crematorium or an incinerator plant, on the night she disappeared. The smug assured look that her husband has displayed since that night while spewing the patently absurd stories of her running off with another man has long convinced me that he absolutely knows that her corpse will never be dug up or be washed up or be found. I believe he personally watched the blue barrel go into a furnace and watched it burn. IMHO its in his eyes.:(

Peterson attorney wants $20 million bond reduced

CHICAGO – Drew Peterson's lead attorney said he'll ask a judge to sharply reduce the former suburban Chicago police officer's bond from the current $20 million to "a reasonable level."

Joel Brodsky said at a news conference Sunday that a bond between $500,000 and $1 million would be within the range set in other murder cases in Will County.

"We are ... going to attempt to get this excessive bond down to a reasonable level and see that Drew is given the same bond as anybody who's accused of a similar crime," Brodsky said.

Peterson remains jailed on charges of first-degree murder in the 2004 death of his third wife, Kathleen Savio. Peterson is a suspect in the 2007 disappearance of his fourth wife, Stacy.

If the bond is reduced to $500,000, Brodsky said he thinks Peterson would be able to pay it. Peterson would have to post 10 percent to go free while he awaits trial.

Later Sunday, Peterson's publicist said Brodsky visited Peterson that afternoon in the Will County Adult Detention Facility in Joliet.

"Drew understands the seriousness of the situation but he is in good spirits and has not lost his sense of humor," Brodsky said in the statement.

Peterson is being held in segregation at the facility, both because he's a former Bolingbrook police officer and because his case is high-profile, Brodsky said.

And given the case's high profile, he said he'll likely ask the judge to move the case out of Will County or to seat a jury from outside of northern Illinois.

He said he hasn't made the decision yet because trying the case among people who know Peterson has its advantages.

"On one hand, Drew has been serving the citizens of Will County for 30 years, he's been a part of the thin blue line that's kept them safe, and he's certainly a well-known member of the community," Brodsky said. "On the other hand, obviously we have to worry about all the tremendous amount of negative publicity that's been given to him."

Peterson is next due in court May 18.

This piece of work scares me to the point I feel compelled to look under my bed at night, thinking he is under it!! What scares me the most is this arrogant prick is a former LE officer and knows his way around criminology and forensics and there is no doubt in my mind that he has murdered both of his wives and I am relieved to know that he is in custody and being held on high enough bail where he won't be out on it to be able to intimidate possible witnesses, who is to say, that he would not use his own children for an alibi or whatever? Like getting his older sons to lie for him because it appears at this stage of the game they have his back, but I have seen cases where that is the case in the beginning and as more evidence mounts, the kids start to doubt. Anyone remember the case of Maria Marshall a young mother from NJ who was murdered by a hit man that her husband Robert O. Marshall contracted because he had fallen into lust with some broad and he knew he would have to pay major bucks in alimony and child support, plus this guy thought he was a big shot, always going to Atlantic City and bragging on the fact he was often comped at all the casinos and how would a divorce look like to all their socialite friends??? His boys were on his side till evidence piled up and his middle son Chris that really started to doubt when his father actually introduced them to his mistress days after Maria was murdered??? His oldest son soon joined in especially when the trial started and this scumbag got a death sentence but it has been commuted to a LWPOP since NJ did away with the DP and I sure would have liked to see this POS gasp his last. He too, thought he was above the law and Drew baby here is not going to be a popular guy behind bars and his arrogance is gonna get him many beatings and he deserves every bit of whatever he gets. Does IL have the DP? If so, then he should go to bat for it. Stacy is buried I think so good, unless he were to confess, that is one body I don't think will ever be found. No one but him knows exactly when she died and I think he decided this time not to leave a body that LE might figure out was marred by homicide like Katherine. And his actions and words the day he got arrested are gonna bite him in the ass, his smart ass remark about the library books, his laughter, coming off like it is all a joke and his actions after Stacy went missing were just as disgusting.

In the whirlwind week since Drew Peterson's arrest for allegedly killing his third wife, Kathleen Savio, the victim's family has fought against defense claims that the case is weak. Savio's sister says she won't quit until the former cop is locked up for good.

"He said to her I can kill you and I can make it look like an accident and no one will know."
Statements like that from Kathleen Savio's sister Sue Doman, who lives in Machesney Park, make up much of the evidence prosecutors plan to use against former Bolingbrook police officer Drew Peterson in his murder trial.

Normally third party claims are considered hearsay and are not allowed in court, but an Illinois law passed in 2007 and nicknamed after Peterson, allows prosecutors to admit hearsay evidence, if attorneys can prove that the defendant killed a witness to prevent testimony.

Peterson's attorney Joel Brodsky plans to fight that ruling. He says, "It's just simply a bad law, it allows rumor."

But Doman believes the evidence will hold up. She says, "My sister had over 100 pages of documentation of everything in her life. She documented all the times she tried to reach out to people and no one responded."

Peterson is being held on 20 million dollars bond and his attorney is fighting to have that reduced. Doman says if he is bailed out, "So be it, I believe in my heart that he will get his time."

She also thinks he'll soon be charged in the murder of his fourth wife Stacy Peterson, who went missing in 2007.

Doman reacted to Peterson cracking jokes in his recent court appearances.
"That's just the way he is. He jokes about everything, but this is a very serious thing. A very serious thing. My family and I are victims. My sister's not here anymore and whether he chooses to go ahead and joke or whatever, he's going to get caught."

Doman will face Peterson in court during his next appearance Monday.
She says for the past five years she's visited her sister's grave, grieving and asking how she died. Savio's birthday is next month and Doman says she's looking forward to going there to celebrate what she hopes is justice being served.

Savio and Stacy Peterson's families are also trying to gain custody of the four children Peterson had with his third and fourth wives. Doman says it's been painful to be separated from the kids and she hopes to welcome them back into her home.

CHICAGO - Christina Raines was not happy to see Fox Chicago News outside the Will County Jail.

The young woman who remains engaged and committed to Drew Peterson, despite his arrest for the murder of his third wife, arrived at the Will County Jail visitation center around 12:30 pm.

Dressed in Capri pants, a white sleeveless sweater and high heels, she chatted with Peterson for a half hour; the allotted time the jail allows.

The visit was in a separate wing of the jail. And, it was not in person. Raines and Peterson could only see one another through a video monitor and a phone handset.

Afterwards, Raines was in no mood to talk about the visit.

When asked why she was at the jail, she told Craig Wall, “None of your f*$%@*in' business.”

CHICAGO – Drew Peterson, charged in the death of his third wife and suspected in the disappearance of his fourth, soon might face another legal battle: a custody fight.

The ex-cop had two children with Kathleen Savio, whom he's accused of killing, and another two with Stacy Peterson, who has been missing since 2007. Drew Peterson's adult son Stephen announced Monday that he has taken custody of the children, but relatives of Savio and Stacy Peterson are looking into whether they can change that.

"We'd seen a lawyer a ways back and were told we'd have to wait until he was charged," said Pamela Bosco, a friend of Stacy Peterson who has acted as a spokeswoman for her family. "We have to go back to a lawyer and see what's available to us."

"It's an issue that's moved to the front burner," said Martin Glink, an attorney representing Savio's father and sister, who filed a wrongful death lawsuit against Peterson shortly before his arrest last week. He added, however, that he hasn't talked about the issue with his clients or anyone else in the Savio family.

Peterson, 55, is being held in lieu of $20 million bond as he awaits a hearing next week on first-degree murder charges in the 2004 death of Savio, who was found drowned in a dry bathtub, a gash to the back of her head.

He has two boys, ages 16 and 14, with Savio and a 5-year-old boy and 4-year-old girl with Stacy Peterson. Peterson has long maintained his innocence in Savio's death and Stacy Peterson's disappearance.

Stephen Peterson, Drew Peterson's son from a previous marriage, issued a statement Monday on behalf of his siblings, noting that they are staying with him.

"All of the children of Drew Peterson fully support their father and know that he is innocent of the charges against him. We know him better than anyone else in the world and we know he is not guilty," Stephen Peterson said.

Drew Peterson wanted his children to stay with his adult son, said Reem Odeh, the law partner of Joel Brodsky, Peterson's attorney, who has worked on Peterson's behalf.

After Peterson's arrest, the state's Department of Children and Family Services turned his children over to "relatives" they would not identify. The child welfare agency also investigated Stephen Peterson's home, Odeh said.

Chicago attorney Matthew Kirsh said the current custody arrangement may be hard to challenge.

"A parent whose rights have not been terminated has the right to designate a guardian in writing," Kirsh said.

After the Savio family filed the wrongful death lawsuit, Peterson appeared beside his teenage sons on CBS's "Early Show," during which the older boy defended his father and characterized his grandfather and aunt as virtual strangers.

"I don't remember meeting him," 16-year-old Thomas Peterson said of Henry Savio. "If he was walking down the street I wouldn't recognize him. And my aunt, I haven't seen in six years."

Jennifer Smetters, a family law attorney in Chicago who is not involved with the case, said if she represented a relative of either mother, she would advise seeking guardianship of all four children.

"The court needs to place the children in the home that would serve their best interests," Smetters said. "I would advise them to prepare their home to take all of the children. It's very important that these children don't go through any more upheaval."

Peterson Stepbrother Goes Before Grand Jury

JOLIET, Ill. (CBS) ―

Three people who may become key witnesses in the case against Drew Peterson testified before a special grand jury Thursday. CBS 2's Mike Puccinelli reports it's the same jury that sent Peterson to jail just last week.

Exactly one week after Drew Peterson was arrested and charged with murdering his third wife Kathleen Savio, some of the key players in the disappearance of Stacy Peterson, 23, stopped by the Will County Court Annex in Joliet to testify before the special grand jury.

Thomas Morphey, Len Wawczak and Paula Stark were present to talk to grand jurors investigating the October 2007 disappearance of Stacy, Drew Peterson's fourth wife.

The trio had nothing to say to reporters about their appearance before the grand jury.

Morphey, Drew Peterson's stepbrother, has claimed Peterson roped him into disposing of his wife's body. Morphey first told his story to The Herald News.

Morphey has told investigators he fears he unwittingly helped Peterson load a closed blue barrel containing Stacy Peterson's body into the back of Peterson's Yukon Denali.

Morphey was so distraught over what he might have done, he attempted to kill himself the next day by overdosing on pills. Drew Peterson has long maintained that his stepbrother is mentally unbalanced.

"I think he's attempted to take his own life a few times," Peterson said in a Feb. 8th interview with CBS 2. "And now all of a sudden he's become this hero to his family where before he was nothing but a loser to the family."

Stark and Wawczak are former friends of Peterson who wore a wire for state police investigators and secretly recorded some seven months of conversations between themselves and the former police sergeant.

When Wawczak broke his silence about the wires their friendship ended. Peterson lashed out at the time.

"Lenny made friends with my little boy and now all of a sudden these people have just coldly disappeared from their lives," Peterson said in a February interview. "I thought, Lenny and Paula, that was a cruel thing."

Wawczak and Stark say what would really have been cruel would be to do nothing and let the children continue to be raised by a man who the couple believes killed two of his wives.

Peterson, a former Bolingbrook police sergeant, was arrested last week on two counts of first-degree murder in the 2004 death of this third wife, Kathleen Savio.

Initially, Savio's death was ruled an accidental drowning. The case was reopened after the disappearance of Stacy Peterson. A new autopsy concluded that Savio was the victim of a homicide.

Drew Peterson remains in custody at the Will County Jail on a $20 million bond. He is to appear in court Monday for arraignment. At that hearing, his attorney Joel Brodsky is expected to push for a reduction on his bond.

Two friends of Drew Peterson also testified before the grand jury today, including one man who was among those who found the body of Kathleen Savio five years ago.

Stacy's disappearance has been called a potential homicide and state police list Peterson as their sole suspect.

Ex-cop accused in 3rd wife's death defends remarks

Former suburban Chicago police sergeant Drew Peterson defends his cavalier attitude after his arrest on charges of killing his third wife.

In a clip released Thursday, Peterson tells NBC's Matt Lauer that it's not in his nature to hide.

Peterson called his handcuffs "bling" and his red jail jumpsuit "spiffy" as he was led into court last week. Lauer asked Peterson if he worries such remarks will make him seem unsympathetic.

Speaking by phone, Peterson says "there's no book written" on how he's supposed to act, and he doesn't think it would be better if he had tears in his eyes.

The full interview was to be aired on Friday's "Today" show.

Peterson is also a suspect in the disappearance of his fourth wife. He's being held on $20 million bond.

CHICAGO – Former police officer Drew Peterson pleaded not guilty Monday to killing his third wife, whose death was reclassified as a homicide after the suburban officer's fourth wife disappeared.

Peterson, who has been jailed since May 7, was formally arraigned on first-degree murder charges in the 2004 slaying of Kathleen Savio.

A prosecution bid to change the judge in the proceeding stalled a defense plan to seek reduced bail for Peterson.

Peterson is accused of drowning Savio, who was found dead in a dry bathtub in 2004 with a gash on the back of her head. Her death was originally ruled an accident. But after Peterson's fourth wife, Stacy, disappeared in 2007, Savio's body was exhumed, and authorities reclassified her death as a homicide after an autopsy.

Peterson, 55, has denied any involvement in Savio's death or Stacy Peterson's disappearance.

After his plea, prosecutors asked that Judge Richard Schoenstedt be removed from Peterson's case, citing "grounds of prejudice against the state."

In November, Schoenstedt dismissed felony gun charges against Peterson after Will County prosecutors refused to give the defense communications between Illinois State Police and the state's attorney's office. Those documents had led to Peterson's arrest on the gun charges.

The defense challenged the motion, and a hearing on the issue was set for Thursday before another judge.

The prosecution move derailed defense attorney Joel Brodsky's plan to ask that bail be cut from $20 million to less than $500,000.

"Drew has proven he is not a flight risk or danger to the community. Bonds are not supposed to be punitive, but to ensure someone's presence in court," Brodsky said on NBC's "Today."

Outside court after the arraignment, Savio's family said they did not want Peterson released on reduced bail. Savio's father, Henry, said his one wish is "to have this done."

Savio family members said they think money, specifically Peterson's pension, was a motive in the killing.

Peterson's numerous media appearances, where he has gained a reputation for making smart-aleck remarks, could play a big role as prosecutors try to lock him up.

Peterson, of suburban Bolingbrook, has never shied from the media, seeming to relish the spotlight and often joking to reporters. As he was led to his first court appearance this month, he referred to his prison-issued jumpsuit as a "spiffy outfit."

And that, attorneys say, could be one of Peterson's biggest problems.

"If one wife goes missing and (another) wife is dead, those aren't usually the subject of jokes," said Roy Black, a defense attorney whose clients have included Rush Limbaugh and William Kennedy Smith. "People are going to think this is a very bizarre person, who's more likely to have committed murder than someone who is in mourning."

Brodsky has said that joking around is how Peterson deals with stress.

His personality is "unique, but he's honest," the lawyer said Monday.

"He doesn't try to act or change the way he is in order to come across and I think that that will resonate with the jury to show his honesty if, in fact, he does choose to testify," Brodsky said on ABC's "Good Morning America."

Peterson has said he wouldn't behave any other way.

"Would it be better if I hid my head down and tried to hide my face and hunched and had tears in my eyes?" he asked NBC's Matt Lauer during a telephone interview aired Friday on "Today." "I mean, no, that's just not me."
