I did not find the reading interesting but rather a boilerplate response to a boilerplate motion, neither of which are going to change Simpson's current conditions, IMHO.
B Madoff admitted stealing 50 billion from people and he is still out on bail.

LAS VEGAS—Prosecutors are telling the Nevada Supreme Court that O.J. Simpson is a flight risk and shouldn't be freed from prison while justices decide whether to overturn his conviction in an armed hotel room heist.
Clark County District Attorney David Roger says in documents filed Thursday that evidence of Simpson's guilt is compelling, and Simpson might disappear if he's allowed to post a bond and go home to Miami.
The prosecutor says Simpson violated a court order in trying to contact a co-defendant before trial. He also claims Simpson tried to influence testimony by a victim in the case by giving him his NFL Hall of Fame ring.
No date has been set for a ruling by the state's only appellate court.

imo the issue of bail should be based on whether oj is a flight risk and whether he can put up the bail. all of this stuff about what someone else did should not effect the decision. the Nevada system is stacked against him and he will not get bail as a method of punishment.

LAS VEGAS—O.J. Simpson's former golfing buddy and co-defendant in an armed hotel room heist is asking the Nevada Supreme Court to let him out of prison pending his appeal of his conviction and sentence.
A clerk at the state's only appellate court says Clarence "C.J." Stewart's request for unspecified bail was filed Thursday.
The 55-year-old Stewart is serving 7 1/2 to 27 years for kidnapping and assault with a deadly weapon in the gunpoint robbery of two sports memorabilia dealers in September 2007.
The 61-year-old Simpson is serving nine to 33 years. He filed a similar request June 1, which is being opposed by Clark County District Attorney David Roger.
Roger also plans to fight Stewart's release.

wonder what the odds are in Vegas that orenthal will get out on bail? I can't imagine the Court taking the request seriously. Good grief, the man has been found liable for the brutal and vicious butchering of two human beings, his attempt to flee, his domestic violence calls from girlfriend, 911 calls from both daughters (one fo them physical), his total disregard for the Court's instructions to stay away from the witnesses in this trial, and on and on. If he doesn't pose a threat to society/community, then we should let manson rent a room in Florida.

LAS VEGAS (AP) — O.J. Simpson is promising not to disappear or endanger the community if he's freed from prison pending his appeal in an armed hotel room heist, his lawyers told the Nevada Supreme Court.
"Simpson recognizes that he has a heavy burden in demonstrating that his release will pose no danger to the community and that he is not a flight risk," attorneys Yale Galanter and Malcolm LaVergne said in a follow-up document filed Monday with the state's only appellate court. "Simpson will strictly adhere to whatever conditions this court sets for bond."
A three-member panel of Nevada Supreme Court justices plans oral arguments Aug. 3 in Las Vegas on Simpson's request to post unspecified bond while the seven-member court considers his appeal.
Monday's filing followed an initial appeal for bail filed May 28.
The new papers include an affidavit from one of the two memorabilia dealers robbed in the September 2007 encounter, renewing his allegation that Clark County District Attorney David Roger wouldn't let him drop the charges against Simpson.
"I wanted all of the charges against O.J. Simpson dropped," Alfred Beardsley said in the document. "After I testified, the Clark County district attorney's office fabricated the idea that the reason I was a reluctant witness was because Mr. Simpson had intimidated, threatened or promised me something of value."
Roger declined comment Tuesday.
The two-page affidavit also referred to Beardsley's denial before a judge in Santa Monica, Calif., that he received Simpson's NFL Hall of Fame ring to change his story in the Las Vegas case.
"Mr. Simpson has never promised me anything for me to testify the way I did," Beardsley said.
Simpson, 61, is serving nine to 33 years for kidnapping and assault with a deadly weapon in the gunpoint robbery of Beardsley and memorabilia broker Bruce Fromong in a Las Vegas hotel room in 2007.
A lawyer for Simpson's convicted co-defendant, Clarence "C.J." Stewart, said Stewart also plans to file follow-up bail request documents before a separate Aug. 3 hearing by the state Supreme Court panel.
Roger has filed documents asking the state high court to keep Simpson locked up, citing the length of his sentence and Simpson's admission in 2008 that he violated a court order by trying to contact a co-defendant before trial.
Simpson's lawyers say Clark County District Court Judge Jackie Glass never made a specific finding that Simpson was a flight risk or a danger to the public.

They have told a US appellate court that there's no risk of Simpson disappearing or endangering the community if he's freed from prison this time he promises that he will not take long rides in Broncos.
Since Simpson’s conviction, one of two memorabilia dealers robbed in of memorabilia in a hotel room in September 2007 now says he wants charges against Simpson dropped. LOL -- the guy that was there to sell orenthal's 'stolen' stuff and the same guy that had telephone conversations with orenthal after the robbery.
Alfred Beardsley has sworn under oath that Simpson has not promised him anything to change his story in the case. wink, wink
A three-member panel of judges will decide on August 3rd if Simpson can be released.
I cannot believe that anyone in their right mind would let that psychopath out to roam the streets yet again. orenthal james simpson pled guilty of domestic abuse, found liable for the brutal deaths of two human beings, and now armed robbery. IMHOO....OJ is exactly were he needs to be...behind bars and if the three judges are fool enough to allow him to have bail they also need to be liable for any crime OJ is subject to commit once he is out of the pokey.

I just cannot imagine that any sane person would consider releasing him. He has a violent history to include the 'smack down' with arnelle just months before the armed robbery.

Today is O.J. Simpson’s birthday and if he gets his wish, the Juice may soon be on the loose.
The former football star is in lock-up in Lovelock following his conviction on 12 charges stemming from a September 2007 run-in with two memorabilia dealers in a Palace Station hotel room.
He was sentenced on Oct. 3 to a maximum 33 years in prison with no chance of parole for nine years.
The Heisman Trophy winner and his co-accused, Clarence “C.J.” Stewart, were convicted on all counts stemming from the now-famous incident, including two counts of kidnapping, robbery, and assault with use of a deadly weapon.
Simpson’s longtime attorney Yale Galanter previously said an appeal was his client’s “only hope.” :eek:
Galanter and Simpson’s other lawyer, Malcolm LaVergne, will soon ask the Nevada Supreme Court to grant the embattled NFL great bail while they seek an appeal.
A three-justice panel will hear oral arguments Aug. 3 in a Las Vegas courtroom.
LaVergne said bail would be a great belated 62nd birthday gift for his client.
“He’s very excited that there’s going to be a hearing, that’s a good birthday present for him,” LaVergne said.
While LaVergne did not represent Simpson during his three-week trial last fall, he joined Simpson’s legal team in May when he replaced outgoing attorney Gabe Grasso.
There will be no candles on the cake today for the former All-Pro running back. :beer:
“The Nevada prison system does not have protocol for birthdays,” LaVergne said.
The attorney also said he did not know what plans, if any, the fallen football hero had for today or if he was expecting any visitors. :shrug:
“There’s a limited list of people who can go visit him,” he said, “(and) that’s all confidential.” :confused:
LaVergne hasn’t spoken to Simpson in a while but said his client has been a “model” prisoner while serving his sentence and has adjusted reasonably well to life behind bars. ;)
“He’s doing well,” LaVergne said. “He has to be secluded in prison because of who he is. He’s doing as well as he possibly can for someone who’s confined.” :chicken:
LaVergne is hopeful that the panel will agree that Simpson is not a flight risk or public danger, and will grant him bail next month.:no:
Still, he called the possibility of Simpson being released the day of the hearing “a highly unlikely scenario.” :D:beer:
“Nothing will happen that day,” he said, explaining that even if bail is granted, terms and conditions will have to be set, then satisfied before Simpson is released.
Such possible conditions could include remaining in Nevada and checking-in with a probation officer, among others, according to LaVergne.
The defense attorney expects the panel to take a few days before they make up their minds and, if successful, to have Simpson released “a few weeks down the road.”
Only after that happens will Simpson be able to throw himself a belated birthday party.
Until then, however, LaVergne said “He’s got bigger things on his mind than his birthday.” :chicken:

he tried to run before and we know that he blatantly went against the court's order not to contact the witnesses. I just don't see how they could let him out. If I were the people that testified against him, I'd be a-skeered.

I would be scared too -- you know how he acts when he feels backed into a corner. First with killing Nicole and then robbing the dealers on the same day the book was released (at least I think I'm right about that). Don't forget the ran twice - the other time when they were going to arrest him for abusing Nicole.

I was thinking about that and the violence associated with him, bribing the witness, and Scotto contacting witnesses even after the conviction to 'talk' to them.

LAS VEGAS -- Few in Nevada legal circles believe O.J. Simpson has any real chance at freedom when the state’s Supreme Court justices consider letting him trade a prison cell in rural northern Nevada for a golf course in Miami while he appeals his conviction in a gunpoint hotel room heist.
What really has them abuzz is that Nevada’s only appellate court agreed to schedule oral arguments Aug. 3 to hear Simpson’s plea to be allowed to post bond.
“It’s unusual. This is a situation where the Nevada Supreme Court might be accused of politics or being star-struck,” said Michael Green, a state history author and professor at the College of Southern Nevada in Las Vegas. “But this is also a case where they’d want to make sure all the i’s are dotted and the t’s are crossed.”
The Nevada Supreme Court received 1,842 appeals in fiscal 2008, and can take two years to decide cases, court spokesman Bill Gang said. Excluding motions by inmates acting as their own lawyers, the court hasn’t received more than five requests for bail pending appeal in any year since 2000, Gang said.
Only one inmate, Paul Thomas Picetti, gained release in 2007 on a written request pending his appeal of a felony drunken driving conviction.
Not once in the last eight years has the court held oral arguments.
But no Nevada prison inmate is as high-profile as the NFL
Hall-of-Famer, television star and celebrity criminal defendant acquitted in the 1994 slaying of his ex-wife, Nicole Brown Simpson, and her friend, Ron Goldman, in Los Angeles.
It’s been more than 30 years since the state high court granted a high-profile defendant freedom pending appeal. That man, Lawrence Arvey, skipped town.
“That hurt us all,” said William Terry, a veteran Las Vegas defense lawyer who helped represent Arvey. “The Supreme Court is kind of like an elephant, they don’t forget.”
Arvey, a big man and larger-than-life casino figure who wore jogging suits and big wigs to court, went by several names and nicknames including “Candy Man,” “Mr. Chin” and “Big Fat Daddy.” Some of the most prominent attorneys in town, including current Las Vegas Mayor Oscar Goodman and Harry Claiborne, represented him.
Arvey was sentenced in April 1978 to life in prison for sex crimes with minors. The high court granted his release two months later on a $100,000 bond. “Nobody thought he was a flight risk because in 1978 that was such a large amount of money,” Terry said.
Arvey, who would be 69, is still listed as a fugitive.
Terry said that in scheduling oral arguments in Simpson’s case, the court might be signaling that some issues in his appeal have merit.
“In order to get bail pending appeal, you have to show there is a potential of reversal on appeal,” he said.
Simpson’s lawyer, Yale Galanter, said that’s what he hopes, too.
“I know my burden is high. I know them granting bond would be a really rare thing,” said Galanter, whose 30-page appeal calls Simpson’s trial so rife with errors by the judge and prosecutors that his conviction should be reversed.
Galanter said Simpson, who has a residence in Miami, is so famous he couldn’t possibly flee if he is released from prison.
“He’s got no place to go, no place to hide,” his lawyer said. “News crews follow him to the restaurant, to the golf course, to school to pick up his kids. He’s truly one of the most recognizable people on the planet.”
“The unjust outcome of not granting him a bond,” Galanter added, “is that if the case is reversed, he will have sat in prison and been punished for nothing, while the appeal winds its way through the system.”
Simpson turned 62 this month at Lovelock Correctional Center, 90 miles northeast of Reno. He’s been working as a gym janitor while serving nine to 33 years for kidnapping and assault with a deadly weapon in the gunpoint robbery of two sports memorabilia dealers in a Las Vegas hotel room in September 2007.
A former golfing buddy and convicted co-defendant, Clarence “C.J.” Stewart, 55, is serving 7 ½ to 27 years at Northern Nevada Correctional Center in Carson City.
They have separate appeals pending with Supreme Court, along with requests to be let out of prison pending a decision.
Neither will be in court for separate 30-minute oral arguments their lawyers and prosecutors will make before three justices of the seven-member state high court—Michael Cherry, Nancy Saitta and Mark Gibbons. Gibbons is not related to the state’s Republican governor, Jim Gibbons.
JoNell Thomas, a veteran Las Vegas lawyer in the special public defender’s office, called the court’s decision to hold a bond hearing for Simpson and Stewart “encouraging” for other appellants. “This tells me I need to file more bond motions on appeals,” Thomas said.
Howard Brooks, the Clark County deputy public defender who oversees appeals for every convicted indigent defendant in Las Vegas, called it unlikely that Simpson will win his appeal, and more unlikely that he’ll be released on an appellate bond.
“The Nevada Supreme Court reverses about 2 to 5 percent of criminal appeals. That is a very low rate,” Brooks said. “The bottom line is, I’d say his chances of getting bond are one in a million.”
Justices have denied requests for bond by other high-profile defendants, including Sandy Murphy, who served nearly four years in the 1998 death of Las Vegas casino executive Ted Binion before her conviction was overturned. Murphy and co-defendant Rick Tabish won a new trial and were acquitted of murder in 2004.
The court also denied bond in 2004 to Peter Bergna, a former Lake Tahoe-area art appraiser whose conviction in the death of his wife in a staged car crash was later upheld.
Thomas, who read the Simpson appeal brief, said she doubted the high court would reveal during the hearing whether the justices think Simpson has a good case on appeal.
“All they’re saying is there are interesting issues here,” she said. “That’s a long way from saying they’re going to reverse the case.”

Sports memorabilia dealers would be able to conduct hotel room transactions without the constant threat of being raided by a disgraced celebrity and his gang of armed thugs. Nobody would write books explaining how they’d murder their ex-wife if they’d murdered them before they were actually murdered. Sadly, since OJ Simpson was imprisoned, that’s the world we live in now.
But not for long - OJ Simpson might be released from jail soon! Hooray!
Thanks to his conviction for armed robbery and kidnap last year, OJ Simpson won’t be released from jail until somewhere between 2018 and 2042. He’s 62 now, which means that OJ Simpson is going to leave prison a very old man. And, if you ask us, that’s a dreadful shame.
True, he might have masterminded an alarmingly violent criminal operation simply because one man had something that he may have possibly once owned, and phoning up to ask for it back didn’t seem to occur to him. And, yes, he was found responsible for the murder of his ex-wife in a civil case. But even if OJ Simpson is a dangerous, violent lunatic - and for all we know he is - isn’t he too much fun to keep locked up?
We want our old OJ Simpson back. The OJ Simpson who wrote If I Did It, Here’s How It Happened. The OJ Simpson who thought that making a hilarious prank-filled hidden camera DVD would be the best way to endear him to the public again. The OJ Simpson who we now feel sort of uneasy about finding funny in The Naked Gun. That’s the OJ Simpson we want to see back on the streets, and we don’t even care if he goes on a berserk indiscriminate stab-rampage immediately afterwards, either.
And neither does his lawyers, because he’s busy trying to get OJ Simpson released from jail ahead of his appeal, although somewhat inexplicably he isn’t using the argument that the planet needs a second volume of Juiced released on DVD. The New York Times reports:
O. J. Simpson’s lawyer asked a three-judge panel of the State Supreme Court to release Mr. Simpson on bail pending the appeal of his 2008 kidnapping and armed robbery convictions. The lawyer, Yale Galanter, said that the trial had been riddled with legal errors and that Mr. Simpson did not pose a flight risk.
Without wanting to burst OJ Simpson’s bubble, this doesn’t sound very hopeful. Asking the same authorities that are still kicking themselves because they didn’t get you for murder to release you from jail because there may have been some administrative inconsistencies while they were convicting you of that thing everyone says you did sounds like a bit of a stretch.
But even if OJ Simpson’s bid for freedom doesn’t work out, there’s still hope that he’ll release Juiced 2 from jail. True, all the hilarious hidden camera pranks will largely involve OJ Simpson pretending to be the sexually-available wife of violent inmate called Hank, but that’s still worth watching, right?

Reporting from Las Vegas -- Nevada Supreme Court justices appeared cool Monday to arguments from O.J. Simpson's attorneys that the former football star be granted bail while he appeals his armed-robbery and kidnapping convictions.
Simpson's attorney, Yale Galanter, said the notoriety of the NFL Hall of Fame running back -- who was famously acquitted in Los Angeles of the 1994 double murder of his ex-wife and her friend -- made it impossible for him to flee if he were to be released on bail.
"Mr. Simpson is the perfect candidate for bail," Galanter said. "He's got nowhere to go, nowhere to hide."
But the three-member panel -- Mark Gibbons, Michael A. Cherry and Nancy M. Saitta -- noted that granting bail to someone convicted of violent crimes would be highly unusual in both the state and federal court systems.
When Galanter said that Simpson had traveled without incident between Nevada and his Florida home during other court proceedings, Saitta raised her eyebrows. "Everyone believes they have a valid appeal," she later told Galanter.
Simpson, 62, was sentenced in December to up to 33 years in prison for spearheading the armed robbery of two sports memorabilia dealers in a Las Vegas hotel room -- an incident captured in surreptitious audio recordings made by a Simpson associate.
The Heisman Trophy winner and former sportscaster is incarcerated at Lovelock Correctional Center in northern Nevada. He will be eligible for parole in 2017.
"Considering the term of Simpson's sentence, combined with his current age, Simpson is realistically looking at a possible life sentence," Clark County Dist. Atty. David Roger said in court briefs. "Therefore, a flight to avoid a lengthy sentence has to be considered tempting."
Roger also argued in briefs that Simpson had shown a "severe disregard" for the courts. For example, before his Nevada trial, Simpson asked his bail bondsman to give a co-defendant a message, despite a judge's order to have no contact with anyone involved in the case.
It's unclear when the justices will issue their ruling. It's extremely unusual for them to hear a bail request from an appellant, and also extremely rare to grant one.
Galanter and co-counsel Malcolm LaVergne have appealed Simpson's conviction, contending that the trial judge, Jackie Glass, made a litany of errors, including blocking the defense from fully questioning potential jurors and witnesses, and that the largely white jury lacked diversity.

There may be room for Simpson's appeal based on the vagueness of the robbery statute, according to a recent Nevada Supreme Court ruling.
