And make sure you close the window after placing it inside. I will lock out all those, who would try to commit a crime and, unlike my co-justice, I will await your next sample of evidence. If we conclude that you did not intentionally take the rum cake, there can be no crime. Understand. By the way, I think we may need some bourbon balls to wash down the evidence.

Oh yes, I have heard of this thing called patience. However, we're talking about sweet and savory goodies here and patience does not exist for me when it comes to that.

How can I say this without others misconstruing the legal concepts involved in our decisions. In all our endeavors, we mus maintain an air of impartiality and ensure that the process is fair. We can not allow them to think that for one moment we were motivated by our personal preferences. That is why we must consider all the evidence. I implore you to not act hastily as that blueberry pie and those bourbon balls must be sampled in an effort to determine, if martin took the rum cake because it was best, and, if we should decided it was not after sampling the other goodies, then no one can question the fairness of our decision. :)

It means that you have to review all the posts on this thread to see if any laws have been broken and then announce the charges so that the offending party may be informed on his conduct and defend against them. As with our United States Supreme Court, our Supreme Court is excused from charges being brought against it by reason of necessity. :) You may charge martin with stealing of a rum cake but not with bribery, as Justices cannot be bribed, smile.

Martin,

You've been formally charged with theft of a rum cake. You will be required to prove that you are at least 21 and also decide if you prefer a jury trial or not. A date will be scheduled from there.

while it is your right to have a jury trial, I do not see the need to make an unnecessary expenditure of funds when the Justices are able to come to an impartial and sober opinion. By the way did you send the bourbon balls and I think our MAC may need some?:)

It is my opinion that after careful consideration of all the evidence submitted and with the outcry of our public policy statements I can not say that martin intentionally stole the rum cake, as it appears from the evidence submitted that it it too difficult a task to ascertain intent, in that the evidence in favor of his stealing of the cake is of equal weight to that of the evidence against his intent to commit a crime.

While motivation is not required to be proven by the State, I cannot ignore that there has been insufficient evidence produced, which would lead to the conclusion that he did intend to steal the cake as it was the most tastiest of the morsels submitted. Of course, that does not terminate the Court's inquiry as we must analyze whether the crime can be sustained under the standard of general intent. Without a showing that his removal of the cake was more than mere inadvertence and, in profound contemplation of the affect that the bourbon balls may have impaired his judgment, which I have found have a staggering effect on daily living skills, I cannot say that the State reached its requiste burden of proof. I must await the finding, concurrence or dissent and reasoning of the other Justice before the decision can be rendered with validity but my opinion is that of not guilty as charged.

I am pleased to discover that you concur with the decision. However, I do think you meant to say improve rather than impair as it relates to the Court's judgment and I do believe that we should do all that we can to be merry and not make our decisions from anger. More bourbon balls, please!:)

I suppose that you will claim that your indiscretion was another example of your inadvertence. However, this Justice is compelled to inform you that your repeated failures in this matter is highly suspect and your seeming disrespect to the Court, MAC and Warden will not be taken lightly. While I am not able to impose a sentence at this time, I will mandate an order in equity that all your children are to be born healthy but naked.

I have never accused you of taking bribes and, in fact, have warned against the possibility of our conduct being misconstrued to appear as though we accepted bribes, which is why I suggested that we share equally in the evidence sampling so that no one can say that our opinion was slanted by one Justice being able to sample more of the evidence. I think this will be an easy case, since she has already made a declaration against interest. :) I think her penalty should be that she has to provide 10 to the sixth power amount of bourbon balls, 10 to the third power cakes and 10 to the ninth power bottles of rum. However, we can not do anything until she is formally brought up on charges and a trial date set.

Oh - that doesn't even need a jury - the sentence is 10 years on this message board. Just so everyone know's how the law works...you can have as many BB's as you want as long as the mac gets some FIRST.

There is no problem with having as many BB's as one wants. The problem is with stealing. You cannot have had one first, if they were stolen. You need to charge her and I will take your additional sentence under recommendation. However, if found guilty, She will have to supply the amount of BB's, cakes and rum that the law suggests, so that she can be taught the error of her ways and we can enjoy those items. Now, you are not saying that you took part in the theft, are you? :)

Thank you martin. I will take the one closest to the door and leave the one at the other end for Justice Sachel. It's not that I want to be able to escape in times of trouble. It is that I was taught that ladies should be afforded the utmost comfort and I would not want a draft to cause her any illness. :)

I went to LE and told them what happened and they got smart and told me to file a civil suit, because it all seemed to weird to them, and they told me they knew you and did not want to get involved, because you are a celebrity. This is what we will do. I will tell Martin that I know someone that wants to buy your stuff. I will record every meeting I have with any people involved. He will not be alone, because he will need some help carrying your stuff. You get some people together to help us. I will lure them to an out of the way location and you come in with your people and take your stuff back.

yeah, they would probably tell you the same thing and martin would be smart enough to dispose of your stuff, after receiving the complaint, if he had not sold it. I guess you could just chalk it up as a loss. :)

I would like to make a statement here. I knew that there was some kidding of folks on the board regarding whether or not they would join the party thread. I am now getting the idea that it is much deeper than just kidding. I apologize for not realizing this, if this is the case. Sometimes I completely miss underlying meanings from others because it is just not in my own nature. If this is what is happening, then I am not sure I want to participate in the party room...it takes the fun out of it for me.

However, after the thread was started and all were invited, I made another post inviting all. I think this particular thread allows us to deviated from our heated discussions and enjoy each other. I honestly want our Warden back and that is all there was to it. There was no underlying meaning on my part. This is the post, I am speaking of.

I would like to make a statement here. I knew that there was some kidding of folks on the board regarding whether or not they would join the party thread. I am now getting the idea that it is much deeper than just kidding. I apologize for not realizing this, if this is the case. Sometimes I completely miss underlying meanings from others because it is just not in my own nature. If this is what is happening, then I am not sure I want to participate in the party room...it takes the fun out of it for me.

Trust me-everyone's allowed-William and martin can't stand me but look, here I am and despite our differences on the other thread we're joyously contemplating my punishment!

Correction-It is my sincere belief that, if some did not partake, it was their personal choice.

If that is the case, that is ok. I still feel a bit bad about not noticing that there were missing members. I guess I got so into doing what I do best - which is humor - that I did not notice.

Unless I hear different from someone else, I will consider this issue closed.

I hope everyone has had a wonderful weekend...unfortunately that means Monday looms over us again.

When am i going to be brought up on formal charges anyway? And where the h*ll is Justice Sachel anyway? It seems clear to me that all I've gotta do is get her drunk and she'll be too happy to throw the book at me. :beer:

Please do not imply that the Honorable Justice Sachel is unfair. I am sure that after she has had a chance to review the charges and sample the evidence, she will render a lenient decision as she will be in a merry mood. We cannot not help but show mercy in some circumstances.

Trust me-I'm one of the last people who would ever imply that Kate's not fair-drives me nuts sometimes how fair she really is-I'm just saying that she'll clearly be happy if she's drunk:D

Formal charges have been filed locally - a trial date of 11/24 has been set. If Justice Sachel is unavailable, a new trial date will need to be set. The bail will definately be set in BB's. The amount of bail is 1200 BB's.

You are ordered forthwith to remit to our MAC the appropriate number of BB's and a corresponding number of rum cakes. However, should you not be able to produce the bail requested, anyone can place the bail in the amount of 10% and they will be required to secure your attendance at the date of trial. I would place the bail for you but it might be viewed as a conflict of interest. Once the Honorable Justice Sachel makes her return, which we hope will be soon because you have a right to a fair and speedy trial, then we shall set an immediate trial date. We will take into consideration an insanity defense, since you claim not to be able to control your impulses when it comes to BB's. I will have to sample plenty of them to see if there is any validity to your defense. :)
