ONSLOW COUNTY, NC -- The Onslow County Sheriff’s Office reports a Mexican court judge has ruled that Cesar Laurean will be returned to Onslow County.

The sheriff's office says that return could be expected within one week. District Attorney Dewey Hudson said there is the possibility that Laurean could appeal the decision, and the extradition could be delayed, as late as October.

Federal authorities will handle transporting Cesar Lauren back to the Onslow County Jail.

Laurean is accused of killing Lance Corporal Maria Lauterbach, a pregnant Camp Lejeune Marine. Lawmen say he buried her charred body and that of her unborn child in a shallow grave in his backyard in Onslow County.

Authorities tracked Laurean down to Mexico, where he was arrested.

U.S. authorities had to agree Laurean will not face the death penalty in North Carolina before Mexico would agree to extradition.

Nov. 23 – Lauterbach joins Laurean's unit.

April 2007 – Lauterbach tells military officials she has been raped.

May 12 – Marine commanders assign Lauterbach and Laurean to work in separate buildings.

May 24 – A military protective order is issued against Laurean.

June 25 – The protective order is automatically renewed for the first time.

Jan. 8 – Police search the laptop computer of Marine Sgt. Daniel Durham, Lauterbach's roommate. Authorities later conclude he is not involved. First news release about Lauterbach being missing is issued.

Jan. 9 – The Marine Corps says it is cooperating with the Onslow County Sheriff's investigation into Lauterbach's disappearance.

Jan. 10 – Civilian authorities request Durham be returned from a training mission in California for questioning.

Jan. 11 – Authorities believe Laurean flees Jacksonville at 4 a.m. They receive Laurean's note from his wife, Christina, at 8 a.m., and announce four hours later they believe Lauterbach is dead. That evening, the local district attorney says burnt human remains had been found in Laurean's backyard.

Jan. 12 – Authorities complete an excavation of a fire pit in Laurean's backyard and issue a murder warrant for his arrest.

April 11 - Laurean is captured in Mexico.

September 11 - Judge rules to return Laurean to Onslow County.

"I just spoke to the U.S. Justice Department and they told me Cesar Laurean will not be back next week," said Dewey Hudson, the district attorney for the 4th Prosecutorial District, which includes Onslow County.

Hudson said he was "blindsided" by Brown's announcement, and based on the information he has, the earliest Laurean could return to face charges in Onslow County is mid-October.

"A judge in Mexico may have said Laurean should be sent back, but there is still an appeals process," Hudson said. "We don't know whether he will appeal. It is premature right now to say when he will be returned."

"Laurean will not be singled out; he will receive the same humane treatment all the inmates in the jail do," Brown said. "Humans are humans; if you mistreat them for any reason you are not who you are supposed to be."

District Attorney Dewey Hudson said he is confident Brown will take every measure to ensure Laurean is not injured while in the jail.

"We do not want another inmate trying to capture a moment of fame by assaulting Laurean," Hudson said.

Hudson also said he knew Mexican authorities would be watching the court process and outcome of Laurean's trial. He said he did not want anything to happen that could possibly impede future extraditions of other prisoners to the U.S. from Mexico.

RALEIGH, N.C. – A Marine who fled to Mexico shortly before he was charged with killing a pregnant comrade is fighting extradition in a move that prosecutors said could delay or endanger the chances of him going to trial in the U.S.

A North Carolina prosecutor said Monday that Cpl. Cesar Laurean, 21, is appealing to the Mexican courts, arguing that North Carolina's life-without-parole sentence for first-degree murder is barred under the countries' extradition treaty.

Laurean is charged in the slaying of 20-year-old Lance Cpl. Maria Lauterbach, who had worked with him at Camp Lejeune and had accused him of rape. Lauterbach, of Vandalia, Ohio, was eight months pregnant when she disappeared in December.

Laurean fled to Mexico shortly before Lauterbach's burned remains were found in January in Laurean's backyard, and he was arrested in Mexico in April.

In North Carolina, a person convicted of first-degree murder can only be sentenced to death or life without parole.

Onslow County District Attorney Dewey Hudson has already agreed not to seek the death penalty, and a Mexican judge agreed last month to extradite Laurean back to the U.S.

Laurean has appealed that ruling, in part arguing that life without parole is considered cruel and unusual punishment.

Hudson said the argument has been used unsuccessfully in the past, but if the Mexican court sides with Laurean, he could be released from jail.

"Common sense tells me if they're not going to deport him back to (the U.S.), my biggest concern is he could be released to live in Mexico," Hudson said.

It's unclear when the Mexican courts will consider Laurean's appeal. Laurean's attorney, Dick McNeil of Jacksonville, didn't immediately return a phone message, but has said Laurean filed the appeal this month.

The extradition fight could delay his trial for several years, Hudson said.

Hudson said he has been in touch with the U.S. Department of Justice, which is in charge of the extradition, and they told him as much about the appeal as they know.

"It's basically a waiting game for me," he said. "We've done everything we can ... everything we've been asked to do. I don't wanna do anything that's gonna cause any problems here.

Christina Laurean’s Visit to Mexico Has Attorneys on Both Sides of Laurean Case Concerned

It’s been almost eight months since Cesar Laurean was captured in Mexico after fleeing his Jacksonville home.

The Camp Lejeune Marine faces charges that he murdered Maria Lauterbach last December. Investigators allege he then burned and buried her body – and the body of her unborn child – in his backyard before taking off in January.

Laurean is still in a Mexican jail, fighting extradition to the US.

Now, his wife—who is also a Marine—is in Mexico, too.

Christina Laurean in Mexico visiting her jailed husband

A potential witness in the 2007 bludgeoning death of a pregnant Marine has flown to Mexico for what could be a conjugal visit with the main suspect in the case, prosecutors said.

Christina Laurean, wife of Camp Lejeune Marine Cpl. Cesar Laurean who is accused of killing a pregnant colleague, is in Mexico visiting with him now, said Dewey Hudson, the district attorney for the 4th Prosecutorial District, which includes Onslow County.

"It is my understanding that Mexico allows prisoners a conjugal visit on their birthday," Hudson said during a press conference on the Onslow County Courthouse steps Thursday.

Charlotte, NC – Fugitive U.S. Marine Corps Corporal Cesar Armando Laurean will be extradited from Mexico to the United States on April 17, 2009. Laurean was captured in central Mexico in April 2008 after fleeing the United States in January 2008.

Onslow County Sheriff’s Office investigators suspect Laurean in the homicide of 20-year-old USMC Lance Corporal Maria Lauterbach, who was eight months pregnant at the time of her death.

The Onslow County Sheriff’s Office asked the FBI for help locating Laurean when he disappeared on January 12, 2008. He was charged federally with unlawful flight to avoid prosecution (UFAP) in the Eastern District of North Carolina, and a federal warrant was issued for his arrest.

“Now that Cesar Laurean is coming back to the US, Onslow County can move forward with prosecution," said Owen Harris, Special Agent in Charge of the Charlotte Division of the FBI. "He can no longer avoid answering the charges against him. I want to thank everyone who dedicated their time and energy to helping resolve this investigation.”

The FBI, Onslow County Sheriff’s Office, North Carolina State Bureau of Investigation, Naval Criminal Investigative Service, the U.S. Marshals Service, U.S. Immigration and Customs Enforcement, the Bureau of Diplomatic Security, Interpol and the Mexican government all worked together to locate, arrest and extradite Laurean.

An Ohio Air Force reservist may be in Iraq as the man accused of killing his pregnant Marine daughter is brought to trial.

Beginning next week, Master Sgt. Victor Lauterbach is scheduled to deploy for four months with a squadron that handles aircraft cargo. He's the father of Lance Cpl. Maria Lauterbach, a Marine from the Dayton area whose charred remains were found near Camp Lejeune, N.C., last year.

A North Carolina prosecutor says the Marine corporal charged with murdering Maria Lauterbach and fleeing to Mexico has exhausted his extradition appeals and is expected back in the U.S. this week.

Lauterbach's mother, Mary Lauterbach, says she intends to attend
the trial of Cpl. Cesar Laurean even if her husband is away.

Ohio congressman Michael Turner is happy to hear that former marine Cesar Laurean will reach United States soil by Friday.

Laurean is charged with the murder of fellow marine Maria Lauterbach and her unborn child in Onslow County back in December, 2007. He’s been fighting extradition since he was caught in Mexico last year.

Lauterbach’s family lives in Ohio, in the district that Turner represents. Turner recently urged Secretary of State Hillary Clinton to help speed up Cesar Laurean’s extradition process.

Rep. Turner had this to say about the recent developments: ““Cesar Laurean’s extradition is great news. We will soon learn the true story of what really happened in this unfortunate situation. Laurean’s return is a huge step forward for the Lauterbach family as they continue to try to bring closure and peace in this senseless tragedy.”

A Marine who fled to Mexico shortly before he was charged with killing a pregnant colleague in North Carolina returned to the U.S. on Friday.

Cpl. Cesar Laurean, 22, was extradited to face a murder charge in the death of Lance Cpl. Maria Lauterbach, 20, of Vandalia, Ohio, said FBI spokeswoman Amy Thoreson.

Investigators believe he fled just hours before Lauterbach's charred remains were found buried in his backyard in January 2008.

Laurean was taken to the Onslow County jail on Friday evening, county Sheriff Ed Brown said in a statement. Earlier, Onslow County District Attorney Dewey Hudson said he expected Laurean to appear in court Monday.

Mexican authorities captured Laurean just over a year ago in the small town of Tacambaro, Mexico. Thoreson said she wasn't sure where Laurean entered the United States because several agencies were involved and plans changed several times during the day.

Someone arrested on a felony charge must have a first-appearance hearing within 96 hours, Hudson said.

Laurean was charged with first-degree murder after Lauterbach's remains were found in a fire pit behind the home he shared with his wife and daughter in Jacksonville.

Lauterbach, who was eight months pregnant, worked with Laurean at nearby Camp Lejeune. She had accused him of rape, but tests later confirmed he wasn't the father of her unborn child.

Defense attorney Dick McNeil said he hasn't been contracted by federal officials and has heard from Laurean's family but not Laurean. McNeil said he expects his client to plead not guilty.

Hudson agreed not to seek the death penalty so Mexico would consider returning Laurean.

McNeil has said he could seek evidence from prosecutors and begin preparing a defense when his client arrived in Onslow County.

Lejeune spokesman Maj. Cliff Gilmore has said the military intends to expel Laurean when he returns.

Camp Lejeune Marine Cesar Laurean can no longer remain isolated in a Mexican jail. Though, Laurean did everything in his power to avoid facing murder charges in Onslow County. The FBI says Laurean will return to the United States today after being wanted for more than a year. Nine on Your Side’s Laura Vesco spoke with the district attorney to find out what’s next.

Onslow County District Attorney Dewey Hudson says, “There has been a lot of twists and turns in this case and until he gets back on American soil he is in Mexico.“

It’s no wonder why Hudson remains cautious about the return of Corporal Cesar Laurean, the Camp Lejeune marine charged with the murder of pregnant Lance Corporal Maria Lauterbach. Last April Laurean was caught in Mexico after being on the run from law enforcement for three long months. Finally, one year later Laurean is being extradited back to Houston, Texas.

Hudson says, “He will be carried before a judicial official of the state of Texas and at that time he can either waive extradition or if he decides not to waive extradition then we will have to file for a governors warrant.“

If Laurean fights extradition from Texas it will certainly slow the process down.
Reporter: “Hudson says it could be a week or even up to a month before Cesar Laurean is booked here in the Onslow County Jail.“

Hudson says his office will do everything in their power to make sure Laurean goes to trial this fall. “Until he is extradited back here there is no case to try here so as soon as he gets back here I can assure you we will do everything we can to deliver discovery material to whoever his attorney is immediately,“ says Hudson.

Although Laurean’s future is uncertain one thing is for sure he won’t face death since his trip across the border meant Hudson had to take the death penalty off the table to get Mexico to send him back.

Onslow County Sheriff’s Deputies say Laurean will be one of eighteen murder suspects in the county jail. Sheriff Brown says Laurean and his family will be treated the same as any other accused killer.

JACKSONVILLE, N.C. – A judge denied bond Monday for a Marine who fled to Mexico shortly before he was charged with killing a pregnant colleague in North Carolina.

Cpl. Cesar Laurean, 22, wore a bulletproof vest under an orange jail jumpsuit as he appeared in Onslow County District Court. He replied, "Yes, sir" when Judge Paul A. Hardison asked if he understood the charges.

Before the hearing, investigators served Laurean with a search warrant seeking a DNA sample.

He was extradited from Mexico on Friday to face a first-degree murder charge in the death of 20-year-old Lance Cpl. Maria Lauterbach of Vandalia, Ohio.

Authorities said he fled in January 2008, shortly before Lauterbach's burned remains were found buried in his backyard in Jacksonville. Investigators believe she was killed the month before.

Lauterbach, who worked with Laurean at Camp Lejeune and was eight months pregnant, had accused him of rape, but tests showed he wasn't the father of her unborn child.

Laurean attorney Dick McNeil said after the brief hearing he may try to get the trial moved to a different county because media coverage has been extensive.

"If it was a betting thing, Vegas would take it off the board," McNeil said. He said he wouldn't file any motions until he read the 6,000 pages of discovery documents he expects this week from prosecutors.

District Attorney Dewey Hudson said a judge will decide whether to move the trial once a motion is filed. Another hearing is scheduled for May 18.

Onslow County Sheriff Ed Brown said a news conference that the unusual case proves "you can't get away from the long arm of the law." Mexican authorities captured Laurean just over a year ago in the small town of Tacambaro, Mexico.

"Through all my many years in law enforcement, no crime committed in Onslow County or anywhere else has generated so much public response," Brown said.

Laurean is charged with first-degree murder, robbery with dangerous weapon, theft of a financial transaction card, attempted fraud with a financial transaction card and obtaining property by false pretense.

He faces a life sentence if convicted because Hudson agreed not to seek a death penalty so Mexico would agree to extradition.

The Marine Corps said last week it would administratively discharge Laurean.
