SPOKANE -- A nine-month-old baby from Kalispell, Montana is in critical condition at Sacred Heart Medical Center here in Spokane after being sexually assaulted.

The baby boy was flown by air ambulance from Kalispell to Spokane on Saturday and is being treated for a variety of abuse-related injuries including sexual assailt.

Deputies in Flathead County, Montana say that 20-year-old Shane Nickerson volunteered to take care of his girlfriend's baby so she could sleep in.

However Nickerson woke up the woman up early when the child became unresponsive.

"When she went in to look at the child he was severely traumatized and then according to her he was reluctant to go to the hospital he just wanted her to take the child to the hospital," Sergeant Joe Peterson with the Spokane Police Department said.

Once at the hospital in Kalispell doctors noticed the nine-month-old boy had been raped and may have been smothered with a pillow. The boy suffered serious brain injuries.

Nickerson was arrested on a felony assault charge and likely face more counts as the investigation continues.

Nickerson does not appear to have a criminal history however on his MySpace page Nickerson noted that his mother had just passed away in May and that he was dumped by his girlfriend in July. The writings allude to his frustration and anger.

Sgt. Peterson, a detective with the Spokane Police Major Crimes unit, says that letting brand new boyfriends watch young children they are not biologically related to has proven very risky.

"I don't have the statistics but certainly a great cause of death of young children is mother's boyfriends," Sgt. Peterson said.

Now the reason that this happens so often isn't clear but it stands to reason that these new boyfriends either don't have a biological bond with these children or these kids serve as a reminder that their new girlfriend has been involved with other men in the past.

KALISPELL - A 9-month-old Marion boy is in critical condition at a Spokane, Wash., hospital and his mother's boyfriend is charged with sexually and physically assaulting the infant.

The Flathead County sheriff's office says 20-year-old Shane Nickerson was charged Monday with sexual intercourse without consent, sexual assault, aggravated assault and criminal endangerment.

During an initial appearance Monday in Flathead County Justice Court, Judge David M. Ortley set bail at $750,000.

According to court documents, sheriff's deputies were called to Kalispell Regional Medical Center about 10 a.m. Saturday after medical personnel found the child with bruises on his head, a bloody mouth and injuries consistent with sexual abuse. The child's mother told detectives that her boyfriend, Nickerson, had volunteered to watch the child while she slept in Saturday morning.

Maybe you could start a thread to support those statistics? Are there statistics? A lot equals how many?

Of course that wouldn't indicate in any way that fatherless victims deserve such abuse.

That's rather judgmental, don't you think. "a lot" certainly doesn't support a statistical analysis. IMO, there is no such thing as a "fatherless" baby unless, of course, it was a virgin birth. I think it's terribly unfair to catergorize this young mother as being uncaring without actually knowing her. She's most likely going through hell right now and hating herself for trusting the ******* who did the unthinkable to her child. JMO.

Ouch! That's just wrong. I can't imagine what that poor young mother is going through right now. She trusted the wrong person. Look at him, clean cut, nice looking, he probably had alot of people convinced he was a decent person.

Father's die too, you know. Just because a child is being raised by only their mother does not mean that their father cut out on the kid. Not saying that is the case here, just saying you shouldn't make blanket statements like that.

A Marion man plead not guilty to charges of physically and sexually assaulting his girlfriend's 9 month old boy.

Prosecutors believe Nickerson sexually assaulted and beat the child earlier this month while the baby's mother slept nearby.

The baby went to Sacred Heart Hospital in Spokane with bodily and head injuries. Officials believe some of those injuries are related from smothering.

Plea deal falls short in child-abuse case

Police say Kirk Coleman raped his 3-month-old daughter and left her with 17 broken bones last fall. Protesters stood outside the Jackson County courthouse. Many strangers contributed money to help with her care.

Now, a plea agreement intends to put Coleman in prison for no more than five years on a charge of attempted child abuse. We ask if the legal system is treating such a horrendous case as seriously as it should.

The plea deal is puzzling. Worse, it risks sending the wrong message to a community that already fails to protect too many of its youngest members.

Prosecutors and police initially pressed felony charges of abuse in this case. They say they have no doubt Coleman is responsible for the injuries his daughter suffered. If so, why did they not take this case to a trial on charges that reflect how much this child suffered?

This is not a cry from the lynch mob. The court system routinely clears its heavy docket of cases with deals between prosecutors and defense attorneys. Sit on a courtroom bench, and you'll see that justice would stand still if every accused criminal faced a trial by jury. Trials are the exception.

Plea agreements are the justice system's lubricant and — unless you want to pay more in taxes for judges and prosecutors, not to mention jail space — that's the way it should be.

I live in the town where this happend. Heartwrenching! He got off because he had a great attorney, we have a wimp of a prosecutor and a really lax justice system.

This baby was three months old, left with 17 broken bones, raped, sodomized, and permananted brain damage. Three MONTHS old. She nearly died, I have seen the pics of her hooked up to life support. I have held this baby when she was 7 months old and she is such a sweetie. Unfortunately she now has cerebral palsy and seizures.

She is now 13 months old and still can not sit up by her self, hold her bottle or crawl, let alone walk.

And he got ATTEMPTED Child abuse and does NOT have to register as a sex offender. What kind of system is this?

He keeps being referred to as a former army paratrooper that served in Iraq, BS, he was a freaking unsociable paper pusher behind a desk. He comes from a background of a militia loving father, he was a puppy killer and a sibling molester and his excuse was he was drinking and doing drugs.

As a citizen of Jackson Michigan, I am ashamed as to what we allow people to get away with. Especially in the crimes against children.

Jules, don't be sorry. I agree and am so sick of this. This poor child was helpless and defenseless against their attacker. The little gilr is scarred for live and will require constant care it sounds like and he will be out in no time to resume his life without having to register as a sexual predator how sad is that.

Good for you Delaineyrae. I wish I could have been a stay at home mom but I was ative duty so I worked full time and raised 5 kids. I did everything in my power to keep them as safe as I could. I also gave them the tools needed to keep themselves safe.:rose:

This case is sick. About five or six years ago there was a case in my area where a two year old girl was raped by her uncle but this case is more sickening.
