3-Week-Old Baby Shot Saturday
MACARTHUR PARK, Sept. 18, 2007 (KABC-TV) - A 19-year-old reputed gang member was charged with murder in the fatal shooting of a three-week-old baby.
Luis Silva was charged with capital murder in connection with the fatal shooting of 23-day-old Luis Angel Garcia, who was hit by a stray bullet at around 9:30 p.m. on Saturday as his mother pushed his stroller.
Silva is also charged with three counts of attempted murder and one count of attempted extortion.
Prosecutors say gang members allegedly tried to extort money from outdoor vendors on Sept. 1st and one vendor refused to pay. Gang members allegedly returned to MacArthur Park on Saturday and opened fire, hitting one vendor at least twice.
The complaint alleges the special circumstance that Silva committed the murder to further a criminal street gang, which makes him eligible for the death penalty. Prosecutors will decide at a later date whether to seek the death penalty.
Police are still looking for additional suspects.
