Morning Ben,
Just so I can clarify prior to beginning some research on this, were advised that you were restricted from examining his record pursuant specifically to California Government Code 6254 (f) or were you advised that you were restricted from doing so pursuant to California Government Code 6254?

Both! However, initially, just "6254" was stated in a frantic, and nervously, pleading verbal response from L.A. Municipal Court House Mngr. Ann Madden. Can't put much faith in her knowledge about the law. Based upon her response it appeared to be new news to her. Lawyers, Investigators, etc. are examining files everyday in the courthouse, this appeared to be, inadvertently, a special situation for her.
She was caught in a lie, whereas her subordinates had told one of the Johnson Brothers, that head OMIG, that the file had been destroyed. After OMIG sent certified letters to the judges, the judges turned the letters over to Madden, when one of the Johnsons returned 3 months later she had the certified letters in hand and told Johnson that the employees had previously attempted to show the file to Johnson but he had inexplicably left the court house.
She didn't realize that it was one of the Johnson brothers she was confronting with the feable explanation. Johnson said let's dispense with the allegations, you have the file in your hands allow me to review it now. That is when Ms. Madden said she could not. Johnson said, then break the file down and show him what could be seen. She removed 6 inches and offered him one sheet. He said don't bother, I already know what it is. It is the same criminal docket sheet that was offered 3 months earlier when we first asked to reveiw the file. At that point Ms. Madden pleaded with Johnson, please don't make me the bad guy in this, I'm only doing what I've been told.
It is my opinion that the OMIG investigator was truthfully investigating this matter appropriately and systematically, and that his recounting of what occurred is accurate in his then required field report.
A subsequent boiler plate response letter to another OMIG investigator's request came from an L.A.P.D. Public Relations Officer and arrived at the OMIG offices from L.A. Police Chief Bernard Park's office. Within the body of the letter it specifically cites CA. Gov't. Code sec. 6254 (f) as exempting the file from public review. Below is a link to it.
